Cup of Cosy Art is an artist’s website, written and published by Birgit Hämmerle. By accessing this website, you agree to be bound by these Terms and Conditions.

Copyright & Image Etiquette

All images, texts, and designs on this website are the intellectual property of Birgit Hämmerle and are protected under Austrian Copyright Law (§§ 1, 2 UrhG) and EU copyright regulations.

  • No reproduction, copying, or redistribution of any content (including images, text, printables, templates, and digital tools) is permitted without explicit prior consent.

  • Watermarks and text overlays may not be removed or altered.

  • Purchase of an original painting does not transfer copyright. The buyer acquires ownership of the physical artwork but not the right to reproduce or distribute prints of it.

  • Commercial use of any images or content requires written permission.

  • Pinning is encouraged! However, please pin images from their original source to ensure proper credit.

By downloading and/or purchasing any digital item from this website, you agree that it is for personal use only and may not be altered, resold, or uploaded elsewhere.

Prices & Offers

  • Prices for artwork and other products may change at any time at the discretion of the artist.

  • Special offers may apply only to specific products or customer groups (e.g., newsletter subscribers) and will be valid for a limited time. Once expired, they cannot be redeemed.

Payment & Delivery

Purchases can be made via PayPal and Stripe, both of which act as independent data controllers. Payment processing is subject to their respective Privacy Policies and Stripe Privacy Policy.

Some products are shipped directly by me, while others are fulfilled by third-party print-on-demand services (e.g., Gelato).

  • For items I ship personally, I will ensure safe and timely delivery but cannot be held liable for postal delays, customs processing times, or tax-related issues.

  • For print-on-demand items, the third-party provider is responsible for production quality, shipping, and damages in transit. If an issue arises, please contact me, and I will assist in resolving it.

Force Majeure

Neither party shall be held liable for failure to perform obligations due to unforeseeable events beyond reasonable control, including but not limited to:

  • Natural disasters

  • Strikes or labour disputes

  • War, terrorism, or civil disturbances

  • Technical failures, supply chain disruptions, or governmental regulations

If such events occur, obligations shall be postponed for a reasonable period.

I share my creative process and tutorials to inspire others to create their own artwork. However:

  • No liability is assumed for errors in tutorials or project instructions. The methods shared are my personal approach and may not work for everyone.

  • Users should exercise caution and conduct their own research before attempting any techniques described.
